LIABILITY WAIVER AND RELEASE AGREEMENT

Notice: All Children 12 years old and younger must at all times when on the water wear a lifevest. Others must wear or have lifevests immediately accessible when boating.  

 

I acknowledge that I am not under the influence of alcohol or any other medication or substance and that I voluntary request to participate in canoeing, kayaking, swimming, tubing and any watersports activities. I have examined or will examine the rental equipment and agree that it is in good usable condition unless I report a concern or problem after examining the equipment.

 

I am aware:     (1) that any watersports activity is a hazardous activity.

      

                        (2) that extreme care should be exercised when engaged in such activity.

 

                        (3) that life preservers should be worn at all times when on the water.

 

I agree that I shall assume all risk and responsibility for all personal injuries or damages that might occur to me or my property when using the rental equipment or during the rental period.

 

I hereby release Adventure Marine Ltd. and Woy Bridge Campground, and its employees, officers, directors, shareholders, or agents (releasees) from any liability for such injuries or damages. I also agree to make no claim against or sue the same for injury, death, or damages resulting from my participation in watersports activities.

 

I agree to indemnify and hold harmless from any claims and costs all releasees.

 

I further agree to indemnify and hold harmless from any claims and costs all releasees from any claims by minors who are in my custody as a parent, guardian, or temporary custodian.
